1. DISCLAIMER & PRIVACY POLICY. 
The information we collect through our Site helps us secure donations, process registration applications and better serve our charity partners.  This privacy policy (the "Privacy Policy") covers The D10's website (the "Site") as owned and operated by Six Star Services, LLC dba The D10 (“The D10”). Please read below to review our Privacy Policy and the types of information we gather through our Site. In this Privacy Policy, "we", "us", "our" and other similar references mean The D10 and "you" and "your" and other similar references mean a specific user of the Site. By visiting the Site, you accept the practices described in this Privacy Policy. 
 
2. WHAT INFORMATION DOES THE D10 COLLECT? 
(i) Types of Information Collected - 
We may collect two types of information from you: Server Statistics and Personal Information.
a)     Server Statistics: The D10 may collect the following categories of Server Statistics
  i)         Internet Protocol (or IP) address or device ID/UDID, protocol and sequence information.
  ii)         Browser language and type
  iii)         Domain name system requests
  iv)         Browsing history, such as time spent at a thed10.com, time and date of your visit and the number of clicks.
  v)         Http headers, application client and server banners
  vi)         Operating system and fingerprinting data.
b)     Personal Information: The D10 may collect information you provide to us, also known as “Personal Information.” This is information that identifies you, would enable someone to contact you or may describe your relationship with the D10. This information may include:
  i)         Contact information (e.g., name, address, phone number, email address)
  ii)         Demographic information (e.g., date of birth, gender, marital status)
  iii)         Other personal information required to process a transaction on our site (e.g.,address, postal / zip code, billing information, bank account details, and other payment information)
Please be advised that the D10 relies on third party vendors (e.g. Eventbrite, Stripe)  to process transactions. Those vendors have their own privacy policies and you should refer to them for any questions you may have about the information they may collect about you. 
 
3. How Information is Collected?
(i)  Even if you do not request a newsletter or register for an event, when you interact with our site we may collect certain information. For example, our servers keep an activity log that tracks all visitors to our sites. The information our servers collect may include those items listed under “Server Statistics” above. In addition, we may collect information in the following manners:
a)     Applications or other forms we receive from you or your authorized representative.
b)     The correspondence you and others send to us.
c)     Information we receive through the website.
d)     Information about your transactions with, or services performed by, us, or nonaffiliated third parties.
e)     Information from consumer or other reporting agencies and public records maintained by government entities.
f)      Information from social media outlets (e.g., Linkedin, Facebook, Instagram)

5. Cookies and Spyware
We do not install spyware on your computer nor do we use spyware to retrieve information from your computer.
 
Like many other websites we, and our third party vendors, may use cookies, which are small text files stored on your computer when you visit certain online pages that record your preferences (“Cookies”). These Cookies may be used to track your use of our site as well as your use of specific partner sites through promotional links to track transactions made with partners. We may use the Cookies to monitor traffic, improve our site, and make other adjustments to our site to improve visitor experience. 
 
You may receive Cookies from companies with links on our website. We do not control these Cookies. These Cookies are not subject to our Privacy Policy.

6. How We Use Your Information?
(i) Except as otherwise provided in this Privacy Policy, we do not use nor disclose information about your individual visits to our site or your Personal Information collected online to any parties other than those with whom we partner or are affiliated without your consent.
 
(ii) The D10 uses your Personal Information to complete transactions, respond to your requests, deliver the products and services you request, and notify you of promotions, updates, or special offers (which may be offered by The D10 or one of its Site Affiliates via email) that we think may interest you. If you have already signed up on our mailing list and are already receiving thedecathlon.org or thed10.com emails and no longer wish to receive such communications, simply notify us that you would like to "unsubscribe”.
 
(iii) We may provide your Personal Information and Server Statistics to various individuals and companies, as permitted by law, without obtaining your prior authorization. Such laws do not allow consumers to restrict these disclosures. 
 
(iv) We may share information with our subsidiaries and other affiliated companies, and with other carefully selected vendors and business partners with whom we work (collectively, "Site Affiliates"). All companies that act on our behalf are contractually obligated to keep all information confidential and to use the customer information only to provide the services we ask them to perform for you and us. We may provide aggregate statistics about our participants, donors, traffic patterns and related site information to reputable third party vendors, but these statistics do not include Personal Information. We may disclose Personal Information we collect from you if required to do so by law or in the good-faith belief that disclosure is necessary (a) to obey the law or comply with legal process served on us or our affiliates; (b) to protect and defend our rights or property or the rights or property of other users of our Site; or (c) to act in an emergency to protect the personal safety of users of our Site or the public. On a limited basis, we may also disclose your Personal Information to certain Site Affiliates for their use in contacting you, when we reasonably believe their products or services are complementary to your interests or The D10's business.
 
 
7. WHAT SECURITY PROCEDURES DOES The D10 USE TO PROTECT PERSONAL INFORMATION?
(i) We use physical, electronic, and administrative safeguards to assist us in preventing unauthorized access, maintaining data accuracy, and correctly using your Personal Information. Except as specified in this Privacy Policy, we use commercially reasonable efforts to limit access to your Personal Information to the employees, agents, and officers of The D10 who need the information for their jobs. 
 
8. EXTERNAL LINKS. OTHER COMPANIES OR ORGANIZATIONS MAY HAVE LINKS TO THEIR SITES ON OUR SITE. 
(i) We are not responsible for how these other companies or organizations collect, use, disclose, or secure the information that you provide them. If you choose to access a third party Site linked to our Site, you do so at your own risk and subject to any terms of service or privacy policy (if any) associated with such third party Sites.
 
9. COLLECTION OF INFORMATION FROM CHILDREN. The D10 does not direct any of our content specifically to children. Users of our Site are required to be working professionals and thus a minimum of 18 years old, and any user under 18 is not an authorized user. If we learn that a user is under thirteen (13) years of age, we will promptly delete any Personal Information we have collected about that user. 
 
10. CONSENT TO PROCESSING IN THE UNITED STATES. By providing any Personal Information to The D10, all users, including, without limitation, users in Canada and the member states of the European Union, fully understand and unambiguously consent to this Privacy Policy and to the transfer of such Personal Information across international borders in accordance with The D10's standard operations, including the collection, storage, and processing of such information in the United States of America. 
 
11. YOUR RIGHTS
(i) Under the European Union General Data Protection Regulation, residents of the European Economic Area have important rights regarding access to and control of your personal data, including:
Right of Access: You have the right to ascertain what type of personal data The D10 holds about you and to a copy of this personal data.
Right to Complain: You have the right to file a complaint regarding the processing of your personal data to the Supervisory Authority of your Member State.
Right to Erasure:   In certain circumstances you may request that that we delete the personal data that we hold about you.
Right to Object:  When we rely on our legitimate interests to process personal data, you have a right to object to this use. We will stop processing your personal information unless we can demonstrate an overriding legitimate interests in the continued processing.
Right to Portability: You may request that we provide you with certain personal data which you have given us in a structured, commonly used and machine-readable format and you may request that we transmit your personal data directly to another data controller where this is technically feasible.
Right to Rectification: You have the right to have any inaccurate personal data which we hold about you updated or corrected.
Right to Restriction:  You have the right to request that we stop using your personal data in certain circumstances including if you believe that the personal data we hold about you is inaccurate or that our use of your personal data is unlawful.  If you exercise this right appropriately, we will store your personal data and will not carry out any other processing until the issue is resolved.
 
Note that your rights in relation to your personal data are not absolute and that we must be cognizant of our legal obligations. If you choose to exercise some of your rights, we may not be able to perform the actions necessary to provide the Services or otherwise achieve the purposes set forth above.

12. MODIFICATION OF CHANGES. The D10 may at our sole discretion edit this Privacy Policy. This privacy policy became effective on July 31st, 2018 and was last updated on September 4th, 2018.
